A message from Secretary-Treasurer Ron Herrera:

How many of you really know the fundamentals of the legislation and politics that affect your life? 

This edition of our newsletter strives to take a different approach than those you have read in the past.  We will explore and try to define the importance and necessity of being a Union citizen voter—specifically a TEAMSTER. 
                   
Politics:  In order to survive a barrage of political and legislative attacks, Unions and Union members must fight back by educating themselves.  Making a union member more politically aware will create strength at the ballot box.  Voters in this great nation have the ability and power to create progress with their vote.  It only makes sense that a voter who is more informed on the issues will cast a vote more favorable to our cause.  The Teamster philosophy is simple: elect City, State, and National leaders that are labor friendly. 

We must do our homework on political candidates, especially on their voting history regarding Labor issues.  Our bottom line goal is to hold elected officials accountable to Labor.  An adverse or negative decision on legislation can affect the core foundation of our Union.  For example, our wages, our pensions, our medical benefits and our Union contract could lose substantial strength due to changes in the law.  A simple swipe of a pen could change affect lives. 

Our constant fight against “Right to Work” in this state must never stop.  Thinking it could never happen to us is simply the opening for anti-union advocates to spread their lethal venom.  Union contracts and Unionized companies in other states have suffered the devastation of these changes in the law.  We must make a commitment to one another that we will VOTE smart at the ballot box, thus not allowing the agendas of those who oppose us to advance.  Remember, awareness of the issues is the key to legislative progress for working men and women in this country.

We are proud to announce that Brother Jaime Chavez of UPS Main Street was successful in registering over 2,000 new voters during the Local’s recent voter registration drive, and currently leads all other Locals in this critical undertaking.  Great work Jaime!

If you have not done so already, please sign and return the “Employee Free Choice Act “ support card, and contact your legislators in Congress to urge them to support it.

The Local Union is currently hosting a phone bank at our office every evening Monday through Thursday between now and the November 4th Election, in order to encourage other Union voters in the Western United States to support Labor issues in this Election.  If anyone is interested in participating in this drive or in other efforts surrounding the Election, please contact your Business Representative or call the Local Union office at (877) 785-8396 for more information.

A message from Teamsters Local 396 President Jay Phillips:

The Local Union has ordered copies of the recently ratified UPS agreement.   The new contract books, like the last edition, will contain the National Master Agreement, Western Supplemental Agreement, the Local Package and Sort Riders and the Local 396 addendum.   When the new contract arrives, your Business Representatives will immediately begin distributing copies to the members at the UPS hubs and centers.

The new grievance language has greatly expedited the hearing of grievances at our Western Region panel hearings.  There have been two added “special” panel hearings since January 1, 2008 to clear up backlogged cases.  In an unprecedented move, one of the special panel hearings was conducted, over a three day period, at the offices of Teamsters Local 396, where only Local 396 cases were heard.  The result is that our members are receiving answers to their concerns faster than ever before.  The next Western Panel hearings are scheduled for the last week of July, 2008.

Teamsters Local 396 is again participating in the Annual Teamster Day at Dodger Stadium.  This year’s event is scheduled at 7:10 p.m. on September 20, 2008.  The event is always heavily attended so please let us know early if you would like to attend.  Enjoy spending an evening with your friends, family and Teamster brothers and sisters rooting for the Dodgers.

I’d like to thank our members who volunteered to support the Teamsters Oakland Port Rally scheduled for July 22, 2008.  The bus traveling to the rally filled up very quickly with volunteers.  It will be a long day for the participants, but Teamsters Local 396 members are willing to work hard to support the labor cause and to help those less fortunate than ourselves organize into the Teamsters Union.

You will soon see Teamsters Local 396 members and representatives handing out cards asking for your support for the Employee Free Choice Act.  The Employee Free Choice Act will make it easier for workers at non-union companies to obtain representation by a Labor Union.

This Federal Bill is extremely critical for the members of Teamsters Local 396, since so many of the companies that we work for must compete with non-union companies.  The passage of this act will help the Teamsters level the competitive playing field.  Organizing non-union competitors in the package delivery industry and solid waste industries will force these companies to pay fair wages and benefits.  This consequently helps the Teamsters maintain the high level of compensation our members expect and deserve in the industries we currently represent.

In closing, please remember that 2008 is a critical election year. In November, you will have the opportunity to vote. This is a cherished right that many in the world do not enjoy.  Exercise this precious right and vote in the November General Elections.  If you have not registered to vote, contact your Local Union to receive a voter registration card.  There will also be visits at Local 396 yards by volunteers who will provide you with the opportunity to register to vote.  Thanks for your continued support.

A message from Secretary-Treasurer Ron Herrera:

Our 2008 agenda of “Moving Forward Together” could not have been more clearly defined than on April 17, 2008.  Local 396’s participation in the “Hollywood to the Docks March and Rally” demonstrated our belief in unity and solidarity.  The entire Los Angeles Labor Movement joined with Local 396 in a passionate display of Union solidarity.  The next edition of the Local 396 Newsletter will be dedicated to showcase our Local Union’s involvement in this momentous event.  Local 396 members Larry Berru, Juan Gutierrez, Miguel Lechuga, Santiago Lopez, Percy Martinez, Tony Mathis, and Maurice Thomas marched in this three day event culminating in a huge rally at the Port of Los Angeles on April 17th. 

The administration of Local 396 is proud of each and every one of our members who participated at any level in this inspirational event.  This Local Union also recognizes our marchers for their commitment to complete this twenty-eight mile march.  Each marcher was expected to walk nine miles per day over three days.  More important than the physical strain necessary to complete this daily challenge was the opportunity our members were given to demonstrate their commitment to Unionism.  Teamster pride radiated from each and every Local 396 brother and sister who participated in this event.

One of the themes of this three day event was to demonstrate that the principle of Unionism is alive and well in Los Angeles.  It remains the only vehicle that working class men and women have to defend themselves from corporate greed.  Unfortunately we often forget our history of struggle.  The benefits we enjoy today were fought for by those who came before us.  You give a corporation the foothold to take benefits away and before you know it those benefits are gone.  Non-believers may think that they can do it alone and don’t need a Union, but the reality is that they will not survive without one.  I can’t imagine any corporation opening up their coffers out of kindness.  Let’s not forget that all workers are protected under a Union umbrella.  It is our duty as brothers and sisters of this great Union to remember and thank those who made it possible for our families to benefit from our Union contracts.  Collective strength is power.  Understanding that power will be our catalyst to success.          

The “Hollywood to the Docks March and Rally” was sponsored by the Los Angeles County Federation of Labor and spearheaded by its leader, Sister Maria Elena Durazo.  The Federation membership consists of 350 affiliates with a total membership of approximately 850,000.  This event was a reminder that the Teamsters Union and its members must fight side-by-side with other Unions in order for the American Labor Movement to once again be a force to be reckoned with.  We must all be willing to take that extra step to achieve such a goal if we want our Union to succeed.  Participation is the key!

Nuestra agenda del 2008 de “Un Movimiento Hacia Adelante Juntos”  estuvo mas que claro y definido en Abril 17, 2008. La participación del Local 396 en “La Marcha y Manifestación de Hollywood al Puerto” esto demostró la creencia en nuestra unidad y solidaridad. El Movimiento Laboral entero de Los Ángeles juntos con el Local 396 en una muestra de solidaridad de Unión. La próxima edición de la revista del Local 396 será dedicada a nuestra participación del Local de Unión en este gran evento. Los miembros del Local 396 Larry Berru, Juan Gutiérrez, Miguel Lechuga, Santiago López, Percy Martínez, Tony Mathis, y Maurice Thomas marcharon en este evento de tres días culminando en una gran manifestación en el Puerto de Los Ángeles.

La Administración del Local 396 se siente orgullosa de cada uno de los que participaron en este evento de inspiraron. Este Local de Unión también reconoce a los participantes por su compromiso de completar esta marcha de veinte-ocho millas. Cada uno camino nueve horas diarias por los tres días. Más importante que el desgaste físico necesario, fue el demostrar su objetivo para la causa de la Unión. El orgullo de los Teamsters sobresalió radiante de todos los hermanos y hermanas que participaron en este evento.

Uno de los temas en este evento de tres días fue el principio de unidad estando presente más que nunca en Los Ángeles. Una Unión Laboral fuerte prevalece en la cual solo la clase trabajadora de los hombres y mujeres tienen para defenderse entre ellos de la maldad de las corporaciones. Desafortunadamente, algunas veces olvidamos la historia de nuestros sacrificios de pertenecer a una Unión. Los beneficios que nosotros disfrutamos ahora, fueron peleados por esos que estuvieron antes que nosotros. Y si le damos a las corporaciones el inicio de quitarlos nos quitarían todos los beneficios. Hay algunos que piensan que estarían bien sin las uniones, pero la realidad es que los trabajadores no la haríamos sin la Unión. Las corporaciones no abrirán sus carteras así no más de buena fe de donación. No hay que olvidarnos que todos los trabajadores están protegidos bajo el techo de la Unión. Es nuestra obligación como hermanos y hermanas de esta gran Unión el recordar y dar las gracias a aquellos que hicieron posible los beneficios para nuestras familias en nuestros contratos de Unión. La fuerza colectiva es poder. Y si entendemos este poder podremos obtener el éxito.

La “Marcha y Manifestación de Hollywood al Puerto” fue patrocinada por La Federación Laboral de Los Ángeles y comandada por su líder, Hermana Maria Elena Durazo. La Federación  consiste de una membresía de 850,000. Este evento fue un recordatorio que la Unión de los Teamsters y sus miembros debemos pelear al lado-y-lado con otras uniones para hacer el Movimiento Laboral de América una vez mas la fuerza que le pertenece. Todos debemos de tomas ese paso extra para lograr el éxito de nuestra Unión.  Recuerde, su participación es la llave para una Unión Local Fuerte!

A message from Secretary-Treasurer Ron Herrera:

I hope you all are enjoying this beautiful spring weather.  The Consolidated Disposal Service (CDS) contract negotiations covering over 500 Local 396 Solid Waste members has successfully concluded, and the new contract was ratified with a near unanimous vote.  Special recognition and thanks go out to the CDS members who participated as Negotiating Committee members.  These members worked long and difficult hours to help negotiate one of the best labor agreements in the Solid Waste Industry nationwide.

Among the historic gains achieved in this contract was the successful switch from the Pacific Coast pension plan to the Western Conference of Teamsters pension plan.  With this victory added to those won last fall on behalf of Solid Waste members at Allied Waste, Calmet and CDS Chatsworth, Local 396 has now helped to improve the retirement prospects of over 1,000 Local 396 members by upgrading them from the Pacific Coast plan to the Western Conference of Teamsters plan.

Condolences go out to the families and loved ones of Local 396 members Noel Schott and Dan Nakashima who recently passed.  They will be dearly missed and will remain in our thoughts.

The Local Union urges you to attend our upcoming General membership meetings on April 27th and May 18th.  At the May 18th meeting we will be voting on whether or not to suspend the June, July and August summer meetings as has been the tradition with this Local.

Un Mensaje de Ron Herrera Secretario del Tesoro:

Espero estén disfrutando de un buen tiempo de primavera. El Contrato de Consolidated Disposal Service (CDS) que cubre alrededor de 500 miembros de la Industria de Sanidad del Local 396 ha concluido con éxito, y el contrato ha sido ratificado por un voto unánimemente. Reconocimientos especiales y gracias a todos los miembros del comité que participaron en las negociaciones. Estos miembros trabajaron horas y tiempos difíciles, para ayudar a negociar uno de los mejores contratos laborales en la Industria de Sanidad a nivel nacional.

Dentro de las ganancias históricas que se lograron en este contrato fue el exitoso cambio del Pacific Coast Benefits Pension Plan al Western Conference de Teamsters Pension Plan. Agregando a esta victoria, los que se lograron de parte de la Industria de Sanidad miembros de Allied (BFI), Calmet y CDS de Chatsworth, con esto el Local 396 ha ayudado a mejorar el futuro de los retiros de mas de 1,000 miembros del Local 396 y así mejorando del Pacific Coast Benefits Plan al Western Conference de Teamsters Plan.

Nuestras condolencias para las familias y seres queridos miembros del Local 396, Noel Schott y Dan Nakashima quienes fallecieron recientemente. Serán siempre recordados y estarán en nuestros pensamientos por siempre.

El Local de Unión les urge atender al las siguientes juntas Generales en Abril 27 y Mayo 28 en el cual se llevara acabo la votación para suspender o no las juntas de verano de Junio, Julio y Agosto, siendo siempre esta la tradición.

A message from UPS Coordinator David Castro:

The new language under Article 28 of the Western Region Supplement was proposed in order to expedite the hearing of panel cases.  Several special panels were conducted as a result of this new language.  Special panels were held in January and March in an effort to completely clear the case docket.  The Local Union is pleased to inform you that as of April 2008 all panel filings were heard and the docket is current.   The only cases to be heard in April are new cases. Your Business Representatives have worked hard in the preparation and presentation of your filed grievances at the panel hearings. 

Secondly, three Arbitrations were scheduled during the month of April.  Two of our members were returned to work and the Local is awaiting the decision of the Arbitrator with regards to the third member.  Three arbitration dates have become available in the next few months. The Local Union is reviewing and preparing pending termination and suspension cases to schedule for the recently secured open arbitration dates.

The Local would like to thank Brothers Richard Teems, Merk Williams, Vincent Nishi, and David Castro for participating in Career Week at Miracle Baptist Christian School in South Central Los Angeles. They visited with students from Kindergarten thru Eighth grade and encouraged them to stay in school, emphasized the importance of education and discussed setting goals in life.  The students were honored and impressed to meet with UPS employees and Teamsters Representatives.

Greetings from Secretary-Treasurer Ron Herrera:

February was a very busy month for the Local Union and its membership.  The negotiations between Consolidated Disposal Services (CDS) and Teamsters Local 396 continued into February.  As of the writing of this article, the two parties are close to a tentative agreement.  The CDS/Teamsters rank and file negotiating committee has done a terrific job of assisting the Local Union negotiating team in its effort to win the best possible labor agreement for the workers at Consolidated Disposal.

On Saturday, February 9, the Local Union conducted a new hire initiation meeting for UPS employees.  The newly initiated Teamsters were excited to be sworn in and become members of the strongest Union in the nation, the Teamsters.  Several of the attendees were multi-generation Teamsters with some having parents who are current members of Teamsters Local 396.  It is encouraging to see a new generation of young people who are proud to carry on the legacy and heritage of Teamsters Local 396.  Congratulations to all those attending on your induction into Teamsters Local 396.

There will be a new hire initiation meeting for Sanitation workers in the near future.  You will be contacted as to the dates and times of the meetings.

If for any reason you have not received an invitation to attend an initiation meeting please do not hesitate to contact the Local Union.  You will learn much about the advantages of Teamsters membership and how to maximize the benefits of Union membership at an initiation meeting.

The Local Union also conducted a UPS Shop Steward seminar on Saturday, February 24.  There were nearly one hundred stewards in attendance, which is evidence of the commitment of the membership to dedicating personal time to become informed about the UPS Labor Contract.  Thank you to all the Stewards who attended.

One of the featured speakers at the seminar was Workers Compensation Attorney Steve Scardino.  Mr. Scardino fielded many excellent questions from the Shop Stewards.  Steve remarked to me about the impressive level of skill and knowledge our Stewards possess.  The importance of filing Physician pre-designation forms was emphasized by Mr. Scardino.  Please contact your Steward, Business Representative or Local Union to learn how to file a physician pre-designation form.  Pre-designation offers you the ability to see your Physician if you are injured while working.

I must take a moment to mention the February 25th General Membership.  It was encouraging to see the large attendance despite the cold, rainy weather.   In this day and age of Union apathy, it is heartening to see the membership of Teamsters Local 396 attend their General Membership meetings in such great numbers and show such enthusiasm about their Local Union.

I would also like to extend a thank you to the members of the Teamsters National Black Caucus who dedicated their personal time to speak and mentor the young people attending the Piney Woods School.  Teamsters Black Caucus Member Richard Teems stated that it was a memorable experience to spend time with the students at Piney Woods and that the kids were very appreciative of the help extended by the Black Caucus membership.

I also want to recognize Van Nuys Package Driver Steve Tscherne.  Brother Tscherne recently received an award from the President of the United States honoring Steve’s years of dedication and service to the community through the National Junior Tennis Program.  Congratulations Steve!  

In closing, I want to thank all the UPS workers who honored the Writers Guild of America strike line.  I know that several Package Drivers endured losing their routes for months because they refused to cross the picket line.  It is with great prided that we can say no Teamsters Local 396 member crossed the WGA picket line.

A message from Secretary-Treasurer Ron Herrera:

Happy New Year one and all!  I hope the holiday season was enjoyed to its fullest by you and your families.  It’s incredible that 2008 is off and running so quickly.  Your Local Union is ready, able and charged for any and all challenges that may face this membership in 2008.  Local 396’s mission statement for 2008 will be “Moving Forward Together.”  Our membership will be asked to adopt and promote this slogan so we can prove to Corporate America and to Politicians that our membership is united and not divided. 

We must all get involved in the upcoming February 5th California Presidential primary by voting and encouraging others to speak out through their vote.  The Presidential election this November 2008 must become a priority in all our lives; it will singularly affect us all.          

“Moving Forward Together” is befitting of the political challenges we face together.  Local 396 is one of the top three Local Unions in the entire Teamsters organization in contributions to the DRIVE program.  Approximately 25% of our membership contributes to this most important political fund through payroll deductions.  Our membership led the nation in voter registration during the last presidential election.  These accomplishments are a testament to the type of members that belong to Local 396. 

I can not encourage you enough to please get involved and stay involved.  Our regular Local 396 monthly General Membership Meetings are a great start and a vehicle to keep you educated and aware of current political issues.  Creating a strong political presence in Local 396 has been an intricate part of this administration’s political action plan.  As a reminder the monthly Membership Meeting will be conducted on January 27th commencing at 10:00 a.m.  Any Local 396 Bylaws amendment proposals should be given to Local 396 President Jay Phillips prior to the start of the meeting. 

The UPS 2008 calendar started out January 1st with the implementation of the newly negotiated and ratified language from the National Master Agreement and all supplemental agreements.  Any questions or concerns you may have, please contact your Business Representative or call your Local Union office.  The first initiation meeting for our new UPS members will be scheduled for early February.  Also, on the Local Union’s agenda is a Shop Stewards seminar in the later part of February.  The annual Feeder bid commences in February, and don’t forget that those eligible, prospective Feeder Drivers must attend a Feeder seminar.  The next such seminar will be conducted after the February membership meeting.

Solid Waste members have been actively involved in negotiations and ratifying contracts in LA County.  The Crown Disposal contract remains open but the Local Union is confident that this agreement will reach closure very soon.  Currently, Local 396 is in contract negotiations with CDS Long Beach and Gardena yards (Republic Industries).  The CDS contract includes approximately 550 Local 396 members.  This contract is unique in the fact that it covers such a large group of our members in one agreement, as well as a multitude of job assignments.  Job locations include a bin repair yard, three transfer stations, and two hauling yards.  The contract is complex, but with a great rank-and-file committee and their knowledge of the industry, things are coming along fine.  Local 396 thanks committee members Lorenzo Cueva, Joe Loza, David Marquez, Mayra Muñoz, Roosevelt Murray, Saul Parra, Wilfredo Ramirez and Maurice Thomas and for their hard work.  Brothers Bill Huff and Javier Bonales will be contacting our Shop Stewards for an upcoming seminar as well.  The theme will be contract enforcement and benefit utilization.

Feliz Año Nuevo a todos.  Espero disfrutaron esta temporada de fiestas con su familias.  Es increíble que el 2008 ya empezó tan rápido.  Su Local de Unión esta listo, para atender todos los retos de la membresía que se presentaran en el 2008.  La misión para el Local 396 será “Un Movimiento Adelante Juntos” Nuestra membresía adoptara este lema para promoverlo y así demostrarle a las Corporaciones y a los Políticos en América que nuestra membresía esta unida y no dividida.

“Un Movimiento Adelante Juntos” es de beneficio para los retos políticos que tendremos que enfrentar.  El Local 396 es uno de los tres Locales de Unión más activos en la organización de Teamsters que contribuye al programa DRIVE.  Aproximadamente el 25% de nuestra membresía contribuye para este fondo tan importante en la política a través de deducciones. Sigue abierto pero el Local 396 tiene confianza que se llegara a un arreglo muy pronto.  Actualmente se esta negociando con la yardas de CDS Long Beach y Gardena (Republic Industries).  El Contrato de CDS incluye aproximadamente 550 miembros del Local 396. Este contrato es único cubre un extenso grupo de miembros en un contrato, así como múltiples asignamientos.  El trabajo incluye reparadores de tinas, tres transfers en las dos yardas.

Happy Holidays from Secretary Treasurer Ron Herrera:

I would like to take a moment to thank the membership for its support and unity during 2007.  Teamsters Local 396 Members, throughout the year, demonstrated their interest in the Labor cause by attending meetings, seminars and educational classes offered through the Local Union.  Local 396 members can always be depended on to rise to the challenges that confront the labor movement.

The Local Union has been involved in UPS Contract negotiations and Sanitation Contract negotiations during 2007.  The UPS Contract ratification vote ends November 16, 2007 with the results of the ratification vote due before the end of the year.  As you are aware, the Teamsters are a democratic organization therefore the membership decides whether to ratify any collective bargaining agreement.  Please respect and support each member’s decision on how to vote the UPS agreement.

When the results of the UPS ratification vote are complete the membership will be promptly informed as to whether the tentative agreement has been ratified.  The expiration date of the current UPS agreement is July 31, 2008.  However, if the new agreement is ratified the contract language would become effective January 1, 2008.  The economic language of the UPS tentative agreement would become effective August 1, 2008.

Thanks to the Members who attended the October General Membership meeting.  The Members were provided the opportunity to pose questions about the new UPS Contract to Teamsters Local 396 President Jay Phillips and UPS Coordinator David Castro.  It is our hope that the Membership was better able to make an informed voting decision after having their questions answered.

The UPS Business Agents and Stewards have also been available to explain the new UPS tentative agreement.  The workers at the UPS Main Street hub have had the opportunity to discuss the new agreement with one of their own, Package Steward Richie Vasquez who is a Rank and File Member of the UPS National Negotiating Committee.

The Los Angeles Area Sanitation agreements expired September 30. The Local Union has had multiple meetings with the many groups that comprise the LA Basin Sanitation group including a special meeting with Sanitation members at the October General Membership meeting.  There are several more Los Angeles Area Sanitation agreements set to expire in January, 2008.

As most of you know, the workers at Los Angeles Waste Management Yards located at Sun Valley, Compton and Long Beach, with the support of the Local Union leadership and membership, were on strike in October.  With the supervision of Business Representatives Hector Rendon, David Acosta, Gilbert Castillo and Executive Coordinator Bill Huff the workers stood in unity fighting for a decent contract.  The workers are to be congratulated for the dedication to advance the interest of the Sanitation Workers in the Greater Los Angeles and Southern California areas.

The Local Union is working on its plan for scheduled events for 2008.  For example, a new member initiation meeting is planned for early 2008.  Additionally, Feeder Seminars and Shop Stewards Seminars are also scheduled for the upcoming year.

The UPS Sleeper Team drivers have an informational meeting scheduled December 10, 2007 at the Local Union Offices.  This meeting will serve as an opportunity to clarify and explain the rules and language that is unique to the work performed by Sleeper Team drivers.

Thanks again for helping Teamsters Local 396 remain in its position as a leader in the fight for fairness and justice for the workers in Southern California.

PRESS RELEASE: Teamsters Call On Waste Management to Return To Negotiations

Sanitation Company’s Substandard Wages Threatens the Future of Hundreds of Families

(Los Angeles, CA) – Hundreds of workers remain out on strike Monday morning as Waste Management Inc. (WMI) [NYSE: WMI] maintained the position that its employees do not deserve anything more than the substandard wages and benefits offered in its last proposal. The 450 sanitation workers overwhelmingly voted down the last proposal on October 18, and were forced to strike when the company refused to improve upon the offer.

“It is a disservice by this company to the 450 workers and their families to negotiate this agreement in the media,” said Ron Herrera, Secretary-Treasurer of Teamsters Local 396. “Our union has made it quite clear to Waste Management that we are prepared to return to formal negotiations at any time.”

A hugely profitable company, WMI took in $13.36 billion in revenue in 2006, with a gross profit margin of 35.5 percent over the last five years. Last year, WMI took in an average of $278,395 in gross revenue per employee. Despite these figures, WMI continues to short-change the Los Angeles workers at the bargaining table. In comparison, Waste Management pays as much as $9 per hour more to its workers in other large cities across the country.

“Waste Management’s actions show how little the company respects our members,” Herrera said. “These workers are committed to providing this valuable public service despite the inherent danger to their health and safety the job entails. Our members have made their view of the past proposals very clear to Waste Management and it is time for the company to respect that and return to the table to negotiate a more suitable contract.”

Teamsters Local 396 represents more than 10,000 workers in the LA County area, 3,500 in sanitation and more than 1,000 workers at Waste Management Inc.

PRESS RELEASE: Teamsters at Waste Management Strike For Fair Contract, Respect

450 Los Angeles Sanitation Workers Seek an End to Substandard Wages

(Los Angeles, CA) – On the morning of October 19, more than 450 members of Teamsters Local 396 that are employed by Waste Management Inc. made the difficult decision to go out on strike in an effort to raise awareness of their fight for a fair contract offer from the company. This decision was made after extensive discussion and consideration between the membership and union leadership.

The members voted against ratifying the last contract offer from Waste Management by an overwhelming margin of 247-115. To date, the workers have voted down three offers from the company due to, in part, Waste Management’s refusal to make a serious effort to correct the wage disparity that exists in its system. What the company continues to ignore is that these 450 workers make far less per hour than workers under other Waste Management Teamster contracts in major cities across the country.

“I am out on this picket line because I am in a fight for my family’s future,” said Sylvester Anthony a 29-year employee at Waste Management. “Los Angeles is one of the most expensive places in the country to raise a family and I can barely make ends meet on the wages Waste Management provides. How am I going to explain to my son that I can’t afford to pay for the college education he has worked so hard to earn?”

Waste Management pays as much as $9 per hour more to its workers in other large cities across the country. In comparison, city employees in LA County that perform similar work make up to $6 per hour more.

“Our workers are only asking for comparable wages,” said Ron Herrera, Secretary-Treasurer of Teamsters Local 396. “This is a company that spends millions of dollars sending its strike-breaking ‘Green Team’ around the country. Waste Management spends more on this team than it would take to settle a contract that includes a respectable wage structure. These workers are tired of being victims of a corporate agenda.”

Local 396 has stated publicly that it is prepared to return to negotiations with Waste Management at any time so both sides can work toward constructing an agreement that addresses the workers’ concerns.

PRESS RELEASE: Teamsters A Huelga En Waste Management Por Un Contrato Justo Y Respeto

450 Trabajadores de la Sanidad buscan poner fin a los sueldos inferiores

(Los Angeles, CA) – En la mañana de Octubre 19, más de 400 miembros del local 396 de Teamsters que son empleados por Waste Management, Inc., tomaron la difícil decisión de ir a huelga en un esfuerzo para dar a conocer su lucha, por lograr una oferta justa de la compañía para su contrato. Esta decisión fue hecha después de extensas discusiones y consideraciones entre la membresía y los Lideres de la Unión.

Los miembros votaron en contra de ratificar el contrato en la última oferta de Waste Management con un margen abrumador de 247-115. Hasta ahora los trabajadores han rechazado tres ofertas de la compañía, en gran parte porque Waste Management no ha hecho una oferta seria para corregir la disparidad de sueldos que existen en el sistema. Greetings from Secretary-Treasurer Ron Herrera:

This past year has been busy for your Local Union UPS and Solid Waste contract negotiating teams. The UPS negotiating committee reached a tentative agreement on the National Master Agreement and the Local Area Riders and Supplements. The exception is one Local Union in the Midwest that has yet to finalize negotiations for their Area Rider. However that Local Union is actively working to wrap up this sole remaining open Local agreement.

As of October 10th, which is the date this article was written, final details on the allocation of the UPS economic package are pending. The details of how the UPS economic agreement will be implemented in our Local Union jurisdiction should be available after October 15, 2007.

The current UPS agreement expires July 31, 2008. The International plans to have ballots sent out for ratification before the end of the year. It is hoped that we will have the results of the vote by January 1, 2008. As soon as the remaining details are finalized the UPS membership will be updated on the terms of the new agreement.

There are however areas of the agreement that have been finalized. For instance, the Teamsters Negotiating Committee was able to preserve full Maintenance of Benefits for health insurance. As you are aware, with skyrocketing medical expenses, companies have insisted that workers bear part of the cost of health insurance. In spite of this trend, the Committee was able to win full payment of health insurance premiums from UPS.

Teamsters Local 396 was one of the Locals that was asked to invite a rank-and-file member to the UPS National Negotiations. Main Street Package Driver and Shop Steward Richie Vasquez did an admirable job of representing his Local Union and his UPS Teamsters Brothers and Sisters. He sacrificed much personal time to participate, and we thank Brother Vasquez for his valuable contributions to the negotiating process. Please do not hesitate to ask Richie questions regarding the negotiations.

Overall, the total UPS economic package provides for significant wage and Pension increases. Again, the final numbers on wages, Pension and health insurance contributions will be available soon.

The majority of the Los Angeles area Solid Waste agreements expired September 30, 2007. Your Solid Waste Negotiation Committee is continuing to work on its goal of winning the best possible agreement for our Solid Waste membership.

Your Local Union has the full support of Los Angeles Mayor Antonio Villaraigosa and his staff in these negotiations. The Los Angeles County Federation of Labor as well as numerous local elected officials and community activists have pledged their support to Local 396’s efforts to secure a fair agreement.

The Local Union has been supported throughout these negotiations by a strong and united Solid Waste rank-and-file. The members have spoken with a single voice to the companies that the workers are entitled to an agreement that adequately and fairly compensates them for the dangerous and difficult work they perform so well on a daily basis.

Thank you for your support in our efforts to win excellent agreements with the companies who employ our members.

El año pasado estuvo muy ocupado su Local de Unión con el equipo de negociaciones del contrato de UPS y Sanitation. El comité de negociaciones alcanzo un acuerdo tentativo del Nacional Master Agreement y en la área Local del Rider y Supplements.

Hasta octubre 10 fecha que este artículo estuvo escrito los detalles finales del paquete económico de UPS esta pendiente. Los detalles de cómo el acuerdo económico de UPS será implementado en la jurisdicción de nuestro Local de Unión estarán disponibles después del 15 de Octubre del 2007.

A message from Secretary-Treasurer Ron Herrera:

Your Local Union leadership hopes that this past summer was spent in fun and relaxation. Your hard work deserves to be rewarded with plenty of relaxing down time!

September brings the busiest month of the year for Local 396. The entire staff of your Local Union will be absorbed with a hectic schedule of contract negotiations affecting the vast majority of our membership. Approximately 7,500 Local 396 members are affected by some form of contract negotiations taking place this month. The two major entities involved are UPS and the eight individual Solid Waste companies operating within Los Angeles County.

All eight of these Solid Waste companies have a common expiration date of September 30, 2007. The two largest of these are Waste Management and Allied Waste. The remaining companies are Cal-Met, Crown Disposal, AAA, Frank’s, CDS Republic Services, and Norcal Waste. Approximately 1,050 Local 396 Solid Waste members fall within this common expiration date.

Amazingly, the fate of over 6,500 of our Local 396 members is hanging on the outcome of the series of negotiations now taking place at UPS. UPS members are party to four separate contracts, covering different, regionally based, levels that are negotiated individually. Of course, the most difficult and largest of the four is the UPS National Master Agreement. This Agreement covers the entire United States with the exception of the Chicago area. Over 250,000 Teamster members are included in this massive bargaining unit.

The second of these Agreements is the Western Region Supplemental Agreement, covering the Western United States, and containing critical language that governs sections of our grievance procedure. Lastly, the two Southwest Package and Sort Riders govern our Local rules and benefits. For those of you who can remember a few years back, the Southwest Riders are successors to our old Local 396 Addenda.

Whether you are a Local 396 UPSer or a Local 396 Solid Waste member your contract is equal in importance to this administration. Our number one goal as Local Union leaders is to unify our entire membership in support of each other. Your Local Union administration is 100% in support of our membership. Our collective focus must be attaining a fair contract for all our members. Too often, corporations in this country forget who it is that makes them as profitable as they are. Perhaps they need to be reminded that they need look no further than to their own workers. Remember this—if a fight arises, this Local Union is prepared to stand our ground!

After an approved summer recess, our regularly scheduled General Membership Meetings will resume on Sunday September 30th. It is extremely vital that you attend and participate in the upcoming Membership Meetings. Your Local Union will be addressing many issues concerning our diverse contract negotiations that are currently in progress. Also on the agenda will be a debate and motion on the question of whether our Local Union should begin to once again purchase automobiles, as was the practice in the past. As usual, the September Membership Meeting will be held at the meeting hall of Local 986 at 1221 North Peck Road, South El Monte California 91733 starting at 10:00 a.m. I hope to see you there! WASTE MANAGEMENT LOCKS OUT UNION WORKERS!

On July 2nd Waste Management Inc. (WMI) decided to lock out 500 of our Teamster Local 70 brothers and sisters in Oakland California. Your Local Union has decided to alert you to these developing events by way of this column. Local 396 represents a total of approximately 1,100 WMI Solid Waste industry workers. Approximately 462 of these members in Los Angeles County will soon be in contract negotiations with Waste Management Inc. This administration feels it is our duty to communicate the importance of this situation to the entire membership of Local 396.

Local 70 members believe that this act of disrespect and arrogance on the part of WMI reveals the true attitude of the company towards its workers. Leading up to the June 30 th contract expiration date, Local 70 went on record with a commitment to instruct its members to continue to work throughout the negotiation process. Union negotiator Brother Larry Dias even went as far as to inform Local 70 members that there would be no talk of a strike. In complete contrast to this commitment on the part of the Union, WMI rejected Local 70’s proposal to continue to work and acted to lock out our brothers and sisters at the first opportunity!

Community leaders and elected officials in the Oakland area have come out in strong support of the Local 70 membership and their cause. They have stated publicly that WMI should end this lockout immediately and return to the bargaining table. Other Teamster Locals, along with other Unions, have rallied in a strong show of solidarity for Local 70 members. Oakland Mayor Ron Dellums has intervened and is actively urging the parties to work out an agreement, and has called on WMI to lift the lockout.

Temporary replacement workers have been brought into Oakland from all parts of the country to attempt to do Union Work. These replacements are part of a strike breaking team which WMI employs and utilizes in this type of situation. WMI has gone so far as naming their replacement unit the “Green Team.” The Green Team’s main objective is to intimidate and demoralize Union workers.

Local 396 members have first hand knowledge of these WMI intimidation tactics. In September 2006, during the Orange County Solid Waste negotiations, WMI attempted to flex its muscles and employ these disrespectful and intimidating practices against our members at the facility represented by Local 396 in Irvine. Approximately 170 replacement workers from the WMI Green Team were brought into the facility as replacements. These Local 396 WMI members in Irvine have not forgotten what it felt like to come to work in good faith and have WMI treat them without any appreciation for their past dedicated service to the company.

The situation in Oakland is a clear reminder that workers in this country must be allowed to enjoy the benefits of Union representation and must stand together in solidarity. I for one am tired of hearing or reading criticism about Unions and how we are bad for the American worker. We as a nation must get away from this anti-Union rhetoric, and move toward an agenda of respect for workers’ rights. Waste Management Inc.’s behavior in Oakland should alarm all of us that the American Labor Movement needs to step up its fight against corporate greed!

Waste Management cierra las puertas a trabajadores de Unión. El día 2 de julio Waste Management (WMI). Decidió  cerrar las puertas a nuestros hermanos y hermanas del Local 70 de los Teamsters en Oakland  California. El Local 396 representa 1,100 trabajadores de WMI. 462 de estos miembros en el Condado de Los Ángeles estarán muy pronto en negociaciones del contrato con WMI.

Local 70 se comprometió a instruir a sus miembros a continuar trabajando durante el proceso de negociaciones. El negociador de la unión hermano Larry Dias fue aun mas lejos al informar a los miembros del Local 70 que no se hablaría de huelga. En un completo contraste del compromiso de parte de la Unión, WMI rechazo la propuesta del Local 70 de continuar trabajando y actuó cerrando las puertas a la primea oportunidad.

En septiembre del 2006, durante las negociaciones en el condado de orange, WMI intento apretar y empleo estas tácticas intimidatorias e irrespetuosas en contra de nuestros miembros en las instalaciones de Irvine representadas por el Local 396. Aproximadamente 170 trabajadores de reemplazo de el “Equipo Verde” de WMI, fueron traídos a esta facilidad como sustitutos. Estos trabajadores de WMI miembros del Local 396 en Irvine no olvidan como se siente venir a trabajar de Buena fe, y ver que WMI los trato sin ninguna apreciación por el servicio dedicado a la compañía.

La situación en Oakland es un claro recordatorio a los trabajadores de este país que se deben permitir disfrutar los beneficios de ser representados por la Unión, y estar de pie juntos en solidaridad, por mi parte estoy cansado de escuchar o leer criticas acerca de las Uniones y que tan malos somos para los trabajadores americanos. Nosotros como nación tenemos que apartarnos de estos retóricos anti-sindicatos y encaminarnos en una agenda de respeto hacia los derechos de los trabajadores. El comportamiento de WMI en Oakland debería darnos la voz de alarma de que el movimiento laboral Americano necesita levantar su lucha en contra de las corporaciones avariciosas.

A message from Secretary-Treasurer Ron Herrera:

Can you believe it, summer is here! Your Local Union hopes that this time of year brings time off as a reward for your hard work. It’s time to enjoy family vacations or just take some time to relax. Hope you have a great summer!

UPS National Contract Negotiations are scheduled for the first two weeks of June. Negotiation meetings for your supplemental contracts, the Southwest Package/Sort Riders and the West Region Supplement are scheduled for the last two weeks of the month. It has been a grueling schedule for those Committee members involved but the Teamsters are up for the challenge.

Your National Negotiations Committee through the leadership of Co-Chairman Brother Ken Hall has been working diligently to reach an agreement with UPS. Brother Hall’s primary objective is that this Agreement be satisfactory for the UPS membership. His dedication to the membership is an inspiration to us all. Negotiations have been ongoing since January of this year and have not let up. Our Union Committee was selected by Co-Chairmen Ken Hall and our General President Jim Hoffa.

Our Union Committee is made up of national leaders that have a vast knowledge of the UPS structure. Add their collective experience to this mix, and these two elements bring the Union a Committee that UPS respects at the bargaining table. It has been quite an experience for me participating as a member on this Committee. The education and knowledge obtained at these negotiation sessions is unprecedented. Being able to listen and participate in argument and discussion with Brother Hall has been an opportunity not only for me but for our Local Union. There is not an individual more capable to negotiate against this giant than Brother Ken Hall.

Local 396 President Jay Phillips and Local 396 UPS Coordinator David Castro have also participated in this most important process. Understanding that knowledge and experience is the key to representing members, your Local 396 Business Agents have intermittently participated in the negotiations as well. Having first hand knowledge of your contract and how it was negotiated is paramount in providing the representation that Local 396 members deserve. This knowledge will translate into a more informed and educated membership.

The Local 396 Sanitation Staff has been active negotiating contracts and winning grievances. Our most recent contract ratification was held for the Waste Management Corona/Chino facilities. These negotiations were tough, with the Local Union having to file an Unfair Labor Practice charge against the employer. A special meeting was held after the May General Membership Meeting to discuss this issue with the members involved. I am proud to report that Local 396 prevailed and our members benefited from this action. When a Local Union is united like ours is, good things happen.

Rank and File negotiation committee members Daniel Barrios, Hernesto Gudiño, Gary Lara, Isidro Valdivia and Luis Barba did a great job representing their respective work sites. The Local Union believes that rank and file involvement in this process only strengthens our Union. Thanks to those committee members who gave their time and effort in support of Local 396 and the membership.

Sanitation Industry Coordinator Javier Bonales has continued his unwavering commitment to keeping the membership informed, educated and involved throughout this entire process. It is this dedication that makes victories like this possible, and allows Sanitation members to build on these accomplishments throughout the rest of the Industry.

Los Angeles Sanitation contract preparations are off and running. Contract proposal meetings are currently being held for all companies involved. Rank and File negotiation committees are also being formed to assist and support the Local 396 staff in this process.

Remember, UNITED AND STRONG we will represent our sanitation members in the manner they deserve.

As historically done the June, July and August General Membership Meetings have been suspended by majority vote at the May meeting, and will resume in September.

Las Negociaciones del Contrato Nacional de UPS están en la agenda todo el mes de Junio. La educación y el conocimiento adquirido en estas negociaciones son grandiosos. Esto es de mucha ayuda no solo para mí sino para todo el Local de Unión

Entendiendo que el conocimiento y la experiencia es la llave para representar a los miembros, los Agentes Representantes de su Local 396 han participado intermitentemente también en las negociaciones. Este conocimiento se transforma en una membresía más informada y educada.

El grupo (Staff) de Sanidad del Local 396, a estado activo negociando contratos y ganando casos (grievances). Nuestro contrato mas reciente ratificado, el de Waste Management Corona-Chino. Estas negociaciones fueron muy difíciles. El Local de Unión tuvo que hacer una demanda de practica injusta (Unfair Labor Practice) en el Departamento Laboral en contra de la compañía.

Miembros del comité de negociaciones Daniel Barrios, Ernesto Gudiño, Gary Lara, Isidro Valdivia y Luís Barba hicieron un gran trabajo representando sus respectivas yardas.

El Coordinador de la Industria de Sanidad Javier Bonales, continúa con su incansable compromiso de mantener la membresía informada, educada e involucrada en todo este proceso. Esta dedicación hace que estas victorias sean posibles, y permite a los miembros de Sanidad construir sobre estos logros a través del resto de la Industria.

Las preparaciones del contrato de Los Ángeles están ya a todo vapor. Los miembros del comité de negociaciones están también siendo formados para asistir y apoyar al Local 396 y a sus miembros en el proceso.

A message from Secretary-Treasurer Ron Herrera:

I hope all is well with you and your families. The Local Union has recently completed its annual By Laws amendment vote. For those members that are not aware of the By Laws or the procedure of changing them, the process is as follows:

At a January General Membership Meeting proposals to amend our By Laws are submitted in written form and signed by seven members in good standing. The proposed changes are then read to the members in attendance at the January, February, and March General Membership Meetings. At the March General Membership Meeting a vote is taken to adopt or reject the proposed changes. Special thanks to all those members who attended the March 2007 meeting and participated in this most important vote.

Rules of procedure, oaths, governing obligations, etc. are found in the By Laws. This administration operates with the acknowledgment that our By Laws must be faithfully followed. Any questions that a member may have on this subject can be addressed by simply calling the Local Union, or better yet come and join us at the next General Membership Meeting on May 20 th. As promised at our March meeting, your Local 396 By Laws can be obtained by simply contacting the Local Union offices. You can likewise receive a copy of the IBT Constitution upon request.

Education, awareness, and participation are the ingredients of a strong and vibrant Local Union. This administration and the members of Local 396 must work together in realizing these goals. We must not allow fear to dictate what we feel is right for this Union. Let’s make a difference, let’s make a stand, stand up for our rights, and stand up for our Union.

Remember, an engaged and mobilized membership is what employers fear. We have to fight together to beat Corporate America. A divisive agenda only weakens our struggle against corporate greed. I can’t encourage you enough to get involved and to participate!

Our focus in 2007 has been to create an agenda of education for our Stewards. We started out by conducting a Stewards seminar on March 10th. The purpose of this seminar was to better prepare our Stewards in the art of representation. This seminar was extremely beneficial for those who attended. Labor Law Attorney Joseph Kaplon spear headed a frank and lively discussion on a Steward’s role and rights. Mr. Kaplon gave first hand knowledge on grievance handling and tactics that could be used against management to benefit our membership.

Local 396 President Brother Jay Phillips, an attorney himself, gave a more specific presentation on issues that directly affect Local 396 contracts. Brother Phillips’ pointed discussion was overwhelmingly received and appreciated by Stewards from every entity of Local 396. Our Stewards were encouraged to ask questions even if they were tough in nature. The point being that our members rights come first, and if those questions better serve our members, then so be it. The Local 396 Newsletter theme for upcoming editions will be to educate and make you more aware of our TEAMSTERS membership.

Pursuant to Section 19(A)(1) of our Local 396 By Laws, a vote will be taken at the May 20th General Membership Meeting on the question of whether or not to suspend the summer General Membership Meetings (June, July, and August). We hope to see you there!

En la Junta General de Enero las propuestas son sometidas por escrito y firmadas por siete miembros. Los cambios propuestos son leídos en las juntas de Enero, Febrero, y Marzo. En Marzo se toma  el voto para adoptar o rechazar dichas propuestas. Gracias por participar en esta votación.                                                                                                                                  En nuestras leyes se encuentran; Reglas de procedimiento, Juramentos, Obligaciones de Gobierno, etc. Esta Administración opera bajo el conocimiento de que nuestras Leyes deben ser respetadas. Cualquier pregunta que puedan tener sobre este sujeto puede respondérseles llamando al Local o en la junta de Mayo. Como lo prometí en Marzo; las Leyes del Local serán obtenidas llamando al Local, también una copia de la Constitución de la I.B.T si la pide.

Educación, Conocimiento, y Participación son los ingredientes de una Unión fuerte. Esta Administración y sus miembros deben de trabajar juntos para realizar estas metas. No debemos permitir que el miedo dictamine lo que creemos es mejor para nuestra Unión. Hagamos la diferencia; hay que sacar la cara por nuestros Derechos, por nuestra Unión.

A message from President Jay Phillips:

I wish a Happy New Year to the membership of Teamsters Local 396. I eagerly anticipate another challenging yet prosperous year for our Local Union. 2007 presents the opportunity to advance the interests of our membership through new contract negotiations. Additionally, the Local Union Executive Board and Staff are committed to increasing the strength and unity of Teamsters Local 396 through seminars, meetings, events and effective grievance management.

The Local Union recently concluded 2006 with the successful completion of Orange County Sanitation contract negotiations. In the upcoming year, contract negotiations open at Chino Corona Waste Management. This summer also marks the opening of Los Angeles Sanitation Contract negotiations.

As the UPS membership is aware, the Teamsters have started UPS contract negotiations. The IBT is actively engaged in National Master Agreement negotiating sessions. The Teamsters have also started negotiations on the Western Supplemental Agreement and the Southwest Package and Sort Rider. As is fitting for one of the largest UPS Locals in the Nation, Teamsters Local 396 has a seat at the table at all of these negotiations. Your voice will be heard.

During the upcoming year, the Local Union is renewing its commitment to educate the membership about its rights under each member’s respective collective bargaining agreement. A Steward’s appreciation meeting and seminar is planned for March. This will give the Local Union the opportunity to teach Stewards the skills and strategies necessary to enforce our contracts and further increase the knowledge of our more experienced Stewards. Our contract language is strong and with vigilant enforcement of the language our membership will enjoy the protections that our negotiators and members before us fought so hard to win. An informed membership is critical to effective contract enforcement.

In 2007, The Local Union is committed to remaining a force on the shop floor. The Local Union will continue to insist that your Business Representatives make frequent yard visits. Your Business Representatives are also accessible by cell phone and 24 hour messaging at the Local Union office. I encourage members to call the office and ask questions. The Local Union is only as strong as its members and Teamsters Local 396 is committed to strengthening and empowering its membership.

In 2007, the Leadership of your Local Union has renewed its commitment to the communities that serve as home to our membership. Through the Teamsters National Black Caucus, the Teamsters Hispanic Caucus, the Teamsters Women’s Conference, Voter Registration and D.R.I.V.E, the Local Union continues its goal of making Los Angeles County, Orange County, the Inland Empire and the High Desert areas better places to live for our members, their families and their neighbors.

The Local Union is committed in 2007 to continue the growth of Teamsters Local 396 through increasing jobs at existing Teamsters Local 396 shops and through aggressive organizing. Through vigilant contract enforcement the Local Union has increased the UPS Feeder Department from 391 jobs to 700 jobs. This model of growth will continue. Your Local Union also employs a full time organizer who is currently engaged in organizing opportunities at several companies.

Throughout the year the Local Union will plan events where the membership can get together and enjoy the company of fellow Teamsters. Teamsters Dodger Day, a Southern California Teamster tradition, will again be held this summer. The Local Union is planning a summer event in the Lancaster area, so our members who are located in the High Desert can meet and spend time with the Local Union staff. Further details of this event will be released later. However the event will be open to the entire membership of Teamsters Local 396.

In closing, I encourage the membership to be involved in their Local Union. Sometimes our jobs seem overwhelming but knowing that there are others in our great union who are willing to help and support each other can make our difficult jobs easier. Do not be reluctant to use the resources the Local Union makes available. I thank those who have dedicated so much of their time to further the interests of the membership of Teamsters Local 396. The Local Union looks forward to serving you in 2007 and the upcoming years.

Primero quiero desearles Feliz Año Nuevo, y después decirles que esperamos un Año de Prosperidad y Retos. Estamos comprometidos en aumentar la Fuerza y la Unidad del Local396 a través de Seminarios Juntas, Eventos, y un efectivo Sistema de Grievances (Quejas).

Greetings from Secretary-Treasurer Ron Herrera:

The national mid-term elections have concluded and thanks to the hard work of Teamster members like you we will have a worker-friendly Congress in Washington D.C. in January. The new Congress will work to reverse a bleak six years in this country for worker rights and the living standards of working Americans. Your Local Union will continue to work with your elected representatives to assure that your interests are addressed at all levels of government.

The Orange County Sanitation negotiations are near a successful conclusion. New collective bargaining agreements have been ratified at four of our seven sanitation companies represented by Teamsters Local 396. Agreements are expected to be ratified at the three remaining Teamsters Local 396 represented companies in the upcoming weeks. These Local 396 members will enjoy an approximate 25% increase in wages over five years. The Health and Welfare contributions will also increase. The contract language has improved as well as general improvement in other areas of the labor agreements.

A heartfelt thank you is extended to the rank and file committee members who represented their co-workers at the contract negotiation meetings over the past two months. Your efforts greatly contributed to the achievements gained in the negotiation process. The quality of the final contract is a long lasting testament to your hard work. The Local Union and your co-workers owe you a debt of gratitude for the hard work and sacrifices you made to obtain a fair, decent agreement.

UPS negotiations have begun and the process is moving smoothly and productively. The Local Union will keep you informed on developing information from the negotiations. Meanwhile help the Union win a good contract by remaining united and displaying diligence in enforcing the current Contract.

The Local Union recently conducted a new hire UPS Teamsters initiation meeting. It is with pride that I announce that 175 new Teamsters were sworn in and introduced into the brotherhood of organized Labor. Of these new Teamsters, 115 signed up to participate in the D.R.I.V.E. program in an effort to assure electoral and legislative success for working Americans. The Local Union is proud of the contribution offered by our new members and trust that their dedication serves as an inspiration to the rest of our membership.

Remember the next General Membership meeting is Sunday, November 26th.

In conclusion, We wish you and your loved ones a happy and safe Holiday Season. Please plan to attend our annual Holiday General Membership Meeting on Sunday December 17th at 10:00 am. Get there early to avoid the rush. See you there!

Las elecciones termino-medio concluyeron, y gracias en gran parte al trabajo fuerte de los miembros de Teamsters como usted, parece que tendremos un Congreso en Washington a favor de los trabajadores, ya que en seis años se estancaron en este país los derechos y el nivel de vida de la clase trabajadora Americana. Continuaremos trabajando con los representantes electos para asegurar que sus intereses no sean olvidados a cada nivel del gobierno.

Las negociaciones en OC están en camino a una conclusión exitosa, con los contratos ratificados de 4 de las 7 compañías, se espera llegar a un acuerdo con las tres compañías restantes en una o dos semanas. Los miembros del Local 396 obtendrán ahora cerca de 25% de incrementos en sueldos incluyendo incrementos en la cobertura médica, mejoramientos en el lenguaje del contrato y muchos otros beneficios.

Muchas gracias a todos los miembros del comité, quienes representaros a sus compañeros de trabajo en las juntas de negociaciones por los últimos dos meses. Greetings from Secretary-Treasurer Ron Herrera:

Your Local Union has been busy negotiating the Orange County Sanitation Agreements.

Teamsters Local 396 represents approximately 1,200 workers in Orange County. Nearly every Sanitation Worker in Orange County is represented by Teamsters Local 396. These Workers are employed at seven companies servicing every city in Orange County. The labor agreements at these seven companies expire simultaneously on September 30, 2006.

Much progress has been made on securing a good, fair contract for our Orange County Sanitation membership however work still remains to be done. The Local Union is currently working to improve economic portion of the agreement. The Local Union leadership with the help of the rank and file negotiating committee and Membership are close to reaching an economic agreement that will fairly compensate the hard working membership in the Orange County Solid Waste Industry.

The first economic offer by the Orange County Sanitation Companies was put to a Membership vote on October 3, 2006. The Local Union leadership recommended a “no” vote on the proposed agreement. In a resounding vote of support for the Local Union’s recommendations, 97% of the Orange County Sanitation Workers voted against ratifying the agreement. This show of solidarity demonstrates to the Companies that the Membership is united in its effort to win a good, strong agreement. The Members should be proud of their solidarity in the fight to be compensated just and fairly.

In other news, UPS contract negotiations have commenced. The National Master Agreement language proposals have been screened and approved. The Western Supplement and Southwest Rider committees have started the screening process of the proposed language changes with final approval scheduled for the end of October.

Your Local Union staff has been active participants in the UPS negotiations. Your Secretary Treasurer Ron Herrera is on the National Negotiating Committee and is a co-chair of the Southwest Package Rider negotiating team.

Those reading the Teamsters National Magazine and Teamsters UPS publications will recognize that the UPS Teamsters Membership have been recognized prominently in this publications. This is a testament to the hard work, dedication and involvement of the rank and file UPS members in enforcing the UPS Agreement.

The next Teamsters Local 396 General Membership meeting is scheduled for October 29, 2006 at 10:00 am. There will be a vote of the General Membership on a proposed donation to the D.R.I.V.E. legal and education fund. The purpose of this donation is to further the interest of workers and labor in the upcoming California state elections. Please continue our Local Union tradition of active membership participation in Local Union General Membership meetings by attending this meeting. We look forward to your presence and participation.

Please remember to cast your ballots in the IBT General Executive Board elections. The ballots were mailed October 6, 2006. Only 23% of the General Membership voted in the last General Executive Board elections held in 2001. Let’s improve on that total in 2006.

Remember your vote will determine the direction of the IBT leadership for the next five years.

Su local de Unión ha estado muy ocupado negociando el contrato de la industria de sanidad del condado de Orange.

El Local 396 de los Teamsters representa aproximadamente 1,200 trabajadores en el condado de Orange, casi todos los trabajadores de sanidad en el condado de orange son representados por el local 396 de los Teamsters. La primera oferta económica de las compañías de sanidad en el condado de orange se puso a votación el 3 de octubre del 2006, los lideres de la Unión recomendaron votar NO a la propuesta económica de las compañías. En una votación donde se apoyo furtemente la recomendación de su local de Unión 97% de los trabajadores de sanidad del condado de orange votaron NO rechazando la oferta de las Compañías. Esta muestra de solidaridad demuestra a las Compañías que la membresía se encuentra unida en sus esfuerzos de ganar un contrato digno y fuerte. Los miembros deben sentirse orgullosos de su solidaridad en su lucha por una compensación justa.

En otras noticias, las negociaciones del contrato de UPS ya han comenzado. Las propuestas del lenguaje en el contrato han sido revisadas y aprobadas. Los comités del suplemento del oeste y suroeste han comenzado a reviser los cambios en las propuestas del lenguaje con una aprobación final programada para finales de octubre.

Los Agents de su local de Unión han participado activamente en las negociaciones de UPS. Su secretario tesorero RON HERRERA esta en el comité nacional de negociaciones y tiene un lugar en el equipo de negociaciones de paqueterías del suroeste.

Aquellos que leen la revista nacional de los Teamsters y la publicación de los Teamsters de UPS reconocen que la membresía de los Teamsters de UPS ha sido reconocida en estas publicaciones. Greetings from Secretary-Treasurer Ron Herrera:

Your Local Union is starting contract negotiations with the Orange County Sanitation companies and UPS. These two entities represent over 80% of the Local Union membership. UPS agreed to open contract negotiations two years prior to the expiration of the UPS agreement. The Orange County Sanitation contracts expire September 30, 2006 and negotiations begin in August.

The Orange County Contract Committees have been selected and meetings have been ongoing for several months. As this article is written, meetings are being scheduled with the various Orange County Sanitation companies. These meetings initially will permit the committee members and the Local Union to express their objectives and proposals to the company representatives.

Orange County Sanitation contract negotiations will begin in earnest during August and continue until the parties agree on a good, strong contract that satisfies the member’s needs. Remember, Unity and Strength among the membership is critical to achieving a good contract. The Companies will look to exploit any sign of weakness during negotiations.

The Local Union is publishing a newsletter dedicated to Orange County Sanitation members during the contract negotiations. This publication will keep the Orange County Sanitation members updated and informed on the progress of contract negotiations.

Teamsters Local 396, the Southwest Package Rider Locals, the Western Supplemental UPS Contract Locals and the IBT are scheduling UPS contract negotiation sessions. All UPS Teamsters are encouraged to forward proposals for consideration in the upcoming UPS contract negotiations.

The early start of UPS contract negotiations will give the IBT and the Local Union ample time to negotiate the next UPS agreement, which is scheduled to expire July 31, 2008. One of the Local Union’s top priorities is to keep your pension strong and secure while continuing to grow the excellent compensation and benefit package that UPS workers deserve.

You will see Business Representatives at your respective yards asking for your input and ideas for the next UPS Agreement. You may give your proposals to your agents, who will be soliciting proposals at your yards, or forward them directly to the Local Union.

The Teamsters National Black Caucus(TNBC) is having its annual convention in August. Teamsters Local 396 is proud that its members are active in the TNBC. In fact, Teamsters Local 396 member Richard Teems chairs the recently chartered Southern California Chapter of the TNBC.

On another topic, never waive your right to a shop steward. Members are being approached by UPS Security and asked to answer a few questions. Our newer and younger members are often targeted by Management. They are asked to sign a document waiving their right to a shop steward. Never waive your right to a steward, even if you are told that by doing so it will make it “easier.” Demand a Steward, when questioned and immediately call the Local Union if you have been threatened or intimidated, when exercising your right to a Shop Steward.

The next General Membership meeting is scheduled for September 24, 2006 at the meeting hall of Teamsters Local 986 in South El Monte, CA. I will look forward to seeing you there. A message from UPS Coordinator David Castro:

Please be advised that the Summer General Membership meetings were suspended pursuant to a vote of the Membership at the May, 2006 General Membership meeting.

Over 39,000 UPS Teamsters returned their surveys to the IBT Parcel and Small Package Division by the May 30, 2006 deadline. UPS Teamsters gave their input regarding issues that are important to them, when opening new contract negotiations with UPS. The current agreement is scheduled to expire July 31, 2008. UPS Teamster members were given the opportunity to prioritize the issues they find most important. Issues addressed in the survey include wages, pension, health and welfare, safety, excessive overtime and job security. Eighty-nine percent of the members who participated in the survey stated they wanted the Union begin contract negotiations early. The members categorized the pension as the number one issue in contract negotiations.

The latest UPS Teamster Magazine featured Teamsters Local 396 Stewards and Members who were instrumental in identifying and researching Feeder subcontracting claims. Our member’s efforts secured a money settlement and numerous new jobs. Their work also helped other Local Unions identify work and create new jobs. Because of these individual’s vigilance and resistance to subcontracting Local 396’s Feeder Unit continues to grow. Due to this growth a feeder seminar was conducted in May to prepare new feeder candidates. The Local reminds all prospective feeder drivers to keep in contact with Human Resources and complete all requirements for promotion.

Numerous grievances were filed disputing the creation of Article 22.3 combination jobs consisting of work from Local 396 and Local 495 jurisdictions. Local 396 and Local 495 disputed the creation of these jobs at the second level panel maintaining that creating jobs from different jurisdictions then awarding such work to members of Locals who do not have jurisdiction over work is a violation of Article 3, Section 4 of the UPS Teamsters National Master Agreement. The Company has since agreed to remove these jobs and abide by jurisdictional rules.

In closing, please be sure to exercise your right to representation by a Shop Steward, or a designated alternate, when requested at such time as the employee reasonably contemplates disciplinary action. If Management advises you that you do not need a Steward or that it will be easier for you if you do not use a Steward, insist that a Steward be present. Never sign a document waiving your right to a Shop Steward. The next General Membership meeting is scheduled September 24, 2006. I look forward to seeing you there.

Your Local Union is in full preparation for the Orange County Contract negotiations. Many meetings have been conducted with the Rank and File committees for each company. More meetings are scheduled throughout the Summer months. The Companies involved in the negotiations represent 1,200 Teamsters Local 396 Members who are Drivers, Helpers, Mechanics, Welders, Yard Workers and Transfer Station workers.

Contract negotiations will be challenging however with your support and participation we will be successful in our efforts to win a good contract for the Membership. I thank you for the time you have spent helping prepare for negotiations and for the effort you have invested in the negotiating process.

It is important to get involved with contract preparations. I encourage you to talk with the Committee Members and exchange information. It is essential to demonstrate to the Companies that the Membership is unified and supports the negotiations. Remember our ultimate goal, one industry, one contract.

One a different subject, congratulations to Waste Management employees Ramiro Rivas, Delfino Roa, Tomas Vargas, Republic Services employees David Valenzuela, Ernesto Pelayo, David Marquez and Allied BFI employee Ernesto Sanchez for their election as delegates and alternate delegates to the IBT Convention. For the first time in the history of Teamsters Local 396 there is significant and meaningful representation from the Sanitation industry at the IBT Convention

A message from President Jay Phillips:

Congratulations to the Teamsters Local 396 IBT Convention Delegates and Alternate Delegates upon their recent election. The Membership elected twelve delegates and twelve alternate delegates to represent Teamsters Local 396 members at the IBT Convention.

The IBT Convention is held every five years. Candidates for General President and the General Executive Board are nominated at the Convention. Proposed IBT bylaw changes will be considered and policies affecting Local Unions will be discussed at the Convention.

The Teamsters Local 396 Local Union Delegate Representatives consists of the Teamsters Local 396 Executive Board members as well as eighteen Rank and File Members of Teamsters Local 396. The Teamsters Local 396 Delegate Slate is made up of a diverse group of members who represent the different industries that Teamsters Local 396 represents.

The Delegate slate also reflects the various cultures that contribute to the strength and pride of this great Local Union. Congratulations to the Membership for electing a group of delegates that understand the issues that concern the Rank and File Members of Teamsters Local 396 and will proudly represent the membership of Teamsters Local 396.

The year 2006 is an exciting year for Teamsters Local 396. The Orange County Sanitation Contracts expire September 30, 2006. The Local Union has assembled a committee of members from the Sanitation Companies that are represented by Teamsters Local 396 in Orange County and contract negotiations are poised to begin. The Local Union Leadership is committed to winning a good contract for our members.

The Teamsters National Negotiating Committee proposed that the Union and UPS begin contract negotiations. The UPS Agreement expires July 31, 2008. The early commitment to start contract talks is evidence of the IBT's commitment to secure membership involvement in an effort to win a good agreement. Early negotiations will also allow ample time to discuss with the members the issues that are important to our UPS membership.

The UPS Membership will receive surveys from the IBT asking their opinions about UPS contract negotiations. It is important that you answer these surveys so your voice will be heard.

Please be advised that suspension of the Summer General Membership Meetings will be voted on at the May 21, 2006 General Membership Meeting.

In conclusion, please remember, our members' support is critical to the success of the Local Union's goals. Strong contract enforcement, achieved with the help of our Stewards and Members, has resulted in the creation of new Feeder, Package, Combo and Part Time jobs in Teamsters Local 396 UPS jurisdiction. There have been over 210 new Feeder positions created in the last three years and the growth will continue.

The 2006 edition of Teamsters Local 396 contains knowledgeable and enthusiastic members, strong leaders, defined goals and strength through unity. This is a modern Local Union that is politically active and accessible to its members. The Local Union however remains committed to the traditional values of Unionism evidenced by our strength, brotherhood and pride.

Together we will conquer the challenges that approach us in the upcoming three years of our administration. I thank the members for rallying together to make this Local Union one that is respected by the companies, the community and our political leaders. I look forward to seeing you at the General Membership meetings and your respective workplaces.

Felicidades a los Teamsters Local 396 IBT Convención de los Delegados y Delegados Alternos en la reciente elección.

Esta Convención de la IBT se lleva acabo cada cinco años, en la cual se nominaran los Candidatos para la Mesa Ejecutiva, también se discutirán cambios que afectan las leyes y pólizas de la Unión. Los Delegados y Alternos electos por la membresía del Local 396, consiste de la Mesa Ejecutiva así como dieciocho miembros de Teamsters Local 396 y que forman un grupo diverso en las diferentes Industrias, el cual están orgullosos de representarlos para este cargo tan importante.

El año 2006 es un año muy excitante para el Local 396. Los Contratos del Condado de Orange se terminan en septiembre 30, 2006. Con el comité listo para empezar las negociaciones, su Local de Unión esta empeñado en obtener un buen contrato para la membresía.

El Teamsters Comité de Negociaciones de la Unión y UPS propuso empezar las negociaciones. El Contrato de UPS termina en Julio 31, del 2008. A message from Secretary-Treasurer Ron Herrera:

United We Stand, Divided We Fall! 

Let me begin by asking two questions.

First, what does the phrase “United We Stand, Divided We Fall” mean to you? 

Second, have today’s union members forgotten the power this slogan represents?

It’s time for Local 396 members to get back to basic principles.  The Members and Staff of Local 396 working together can transform this phrase into a powerful message.  This message must be communicated among our members. 

Our battle cry for 2006 is UNITY.

Attaining this goal may seem difficult however, by respecting each other we can build a foundation for UNITY.  We don’t have to agree on every issue and we can retain our identities.  But remember, it is vital to our success to ultimately move in the same direction.  Let’s not pull each other apart. We must not allow the road to success to be obstructed by personal agendas, self interest, jealousy or insults. 

It’s okay to be different, as long as these differences don’t create divisions in our Local Union.  Divisions must not be built simply to separate us.  I believe that through unity and solidarity Teamsters Local 396 and the American Labor movement will advance the cause of justice for the American working class.    

Reach out and lend a helping hand.  Let’s show we care.

I encourage you to participate, volunteer, and get involved.  Together we will make a difference.  Adopt this message and believe and we will create power so strong that all unions will rise up politically in this nation.  Let’s not be naïve, trade unions are under attack in this country.  We are at war with Corporate America and the war can only be won by members and staff of Local Unions working together to achieve justice in the workplace. 

Don’t be critical but work together constructively to find solutions to the challenges that face us.  The only entity that benefits from a divided Teamsters Local 396 is management.  Companies take full advantage of members when they see division in a Labor Union.  How can we avoid companies exploiting Labor? By working as one and showing strength through unity!
